2026 Hemp Ban Info & FAQ:
What happened, what it means for CBD users and companies, and how to fight back.
What exactly is happening with the federal and Rhode Island hemp laws, and why are people calling it a ‘hemp ban’?
How will this impact the hemp products I buy and use from Lovewell Farms?
Here’s what we expect, being as honest and clear as we can:
Some products may have to change, but our mission won’t.
The new federal THC cap is so low that it doesn’t distinguish well between intoxicating products and non-intoxicating, full-spectrum hemp. That means we may have to reformulate certain items, change serving sizes, or adjust product formats to stay compliant while still delivering meaningful wellness benefits.Certain flower and full-spectrum products are at risk in their current form.
Because our outdoor organic flower can contain up to 1 mg of THC within otherwise compliant hemp, a large portion of our current harvest would not meet the new definition once it takes effect. Our goal is to adapt genetics and product design rather than simply let those product categories disappear.Marijuana MomentAccess might change even if the product itself doesn’t.
Depending on how Rhode Island implements these laws, some products that are non-intoxicating by design (for example, formulas with a 25:1 CBD:THC ratio that research shows are effectively non-intoxicating) may still be pushed toward dispensary-only channels or face additional licensing hurdles, even though they’ve always been made safely and transparently.Marijuana MomentShort term: you’ll still see your favorites.
Right now, your day-to-day experience with our products is largely unchanged. The federal law has a built-in timeline before it takes effect, and state regulators are still figuring out exactly how they’ll respond. During this period, we’re continuing to grow, formulate, test, and ship products exactly as we always have — under one of the strictest hemp regulatory frameworks in the country.Marijuana MomentMedium term: you might see new labels, new SKUs, or updated formulas.
As the rules crystallize, you may notice:New label language or warnings (to match federal or state requirements)
Rebranded or reformulated products that stay under new THC limits while keeping broad-spectrum benefits
Some SKUs being retired, replaced, or moved into different sales channels if regulators demand it
Whenever we make a change, we’ll tell you what changed and why.
